The Weichert, We Do It All, Guaranteed! program Terms and Conditions

The Weichert, We Do It All, Guaranteed! Program is a unique offering of benefits to buyers who (1) purchase a home from Weichert, Realtors^®, (2) use Mortgage Access Corp. d/b/a Weichert Financial Services ("Weichert Financial Services") for their related mortgage financing, (3) utilize one of Weichert's partners for title settlement services, and (4) obtain a homeowners insurance quote from Weichert Insurance Agency, Inc.  The We Do It All, Guaranteed! program is designed to demonstrate our unique value proposition ‐ an integrated mobility, real estate, mortgage, insurance, title settlement, home protection and moving services customer experience.

There is no obligation to participate in the program or use any settlement services in the future. For buyers to be eligible to receive the benefits of the We Do It All, Guaranteed! program described below, they must satisfy all applicable conditions. Our All Under One Roof^smCustomer Experience team of advisors are available for those buyers that elect to enroll for one or more of the benefits.  Buyers are not required to participate or enroll in the We Do It All, Guaranteed! program or use any Weichert Partner (described below) for settlement services to obtain brokerage services from Weichert, Realtors^®.

Beginning May 1, 2022, the following benefits will no longer be offered under We Do It All, Guaranteed! program: (1) Closing Cost Credit; (2) $50 gift card; and (3) the Weichert Protection Plan.

The We Do It All, Guaranteed! benefits are void where prohibited and are non-transferable. Some We Do It All, Guaranteed! benefits may not be available in all areas. Only ONE buyer and seller Weichert Performance Guarantee is available per subject property transaction.  Not everyone will qualify, and none of the participating Weichert affiliated companies will be liable for disputes over payment or division of payment among multiple parties. Where there are multiple sellers (owners), buyers or non-purchasing spouses in a transaction, such parties are responsible for handling funds or as the law requires. The participating Weichert companies offering the We Do It All, Guaranteed! benefits reserve the right to cancel or modify the We Do It All, Guaranteed! program at any time without prior notice.

Weichert All Under One Roof^sm is comprised of real estate brokerage and related mortgage financing, homeowners’ insurance and title insurance services and products offered by the Weichert^® companies.

Desription of We Do It All, Guaranteed! Eligibility and Benefits*

Eligibility

Subject to the limitations and conditions set forth below, the We Do It All, Guaranteed! benefits are available to buyers who: (1) use Weichert, Realtors^® for the purchase of 1-to-4 family owner occupied primary residence or second/vacation home located in DE, MD, NJ, PA, VA, the District of Columbia, or NY (excluding the counties of Bronx, Kings, New York, Queens and Richmond)*; (2) obtain first lien purchase-money mortgage financing from Weichert Financial Services; (3) close their real estate purchase transaction using a Weichert Partner for title settlement services (where available); and (4) obtain a homeowners insurance quote from Weichert Insurance Agency, Inc. The participating Weichert companies reserve the right to discontinue, cancel or modify the We Do It All, Guaranteed! program at any time without prior notice. Prior to contract execution borrowers must pre-register and use all services to be eligible to receive the benefits of the We Do It All, Guaranteed! program.  Once an eligible buyer registers for the all the We Do It All, Guaranteed! program, the seller of the property will be eligible to register for the Weichert Performance Guarantee.  The seller must be the record owner and seller of the real property described in the original purchase contract between buyer and seller. The Seller Guarantee is available only to sellers who are persons; selling entities, including banks, sole proprietorships, partnerships, limited liability companies, corporations are not eligible for the Seller Guarantee.  Furthermore, co-ops and properties purchased through a “short sale” are not eligible for the Seller Guarantee, and for purchases using FHA loans the seller must have owned the property for at least 180 days at the time the contract is fully executed.

You will be disqualified from the Closing Cost Credit, $50 gift card, and the Weichert Protection Plan if you receive discretionary price changes (pricing concession), which includes meeting a competitive rate offer, renegotiations after rate lock, modifications to loan parameters after rate lock, and borrower(s) requiring closing cost assistance. You will still be eligible for the $5,000.00 Closing Date Guarantee if you meet the other program requirements.

* Due to the lack of a Weichert Partner for settlement services in Delaware and New York borrowers are disqualified from the Closing Cost Credit.

Benefits

Closing Cost Credit
Buyers who submit a fully completed first lien purchase-money mortgage application to Weichert Financial Services by 11:59 p.m. on April 30, 2022 are eligible to receive a $500 lender credit towards closing costs reflected on the Closing Disclosure (CD).  Beginning May 1, 2022, the $500 lender credit will no longer be offered under We Do It All, Guaranteed! program.  Only one lender credit permitted per new loan. This offer is conditioned on obtaining first lien purchase-money mortgage financing from Weichert Financial Services and be subject to credit and underwriting by Weichert Financial Services. The lender closing credit may not exceed out-of-pocket expenses and is valid only for 60 days from the date of the first lien purchase-money mortgage application. The value of the lender closing credit may be reported for tax purposes as required by law. Not all borrowers will qualify. Weichert, Realtors^® is not a mortgage lender. Weichert Home Protection Plan
Buyers who submit a fully completed first lien purchase-money mortgage application to Weichert Financial Services by 11:59 p.m. on April 30, 2022 are eligible to receive a free one-year Weichert Home Protection Plan from Weichert Financial Services, subject to credit approval and underwriting approval and closing with Weichert Financial Services. Beginning May 1, 2022, a free one-year Weichert Home Protection Plan will no longer be offered under We Do It All, Guaranteed! program. The offer is valid only for 60 days from the date of the first lien purchase-money mortgage application. The Weichert Home Protection Plan has a maximum value of $499.00. This offer is void where prohibited and is non-transferable, subject to the terms herein. Buyers are responsible to pay any deductible under the Weichert Home Protection Plan, as well as the cost of any renewal for future Weichert Home Protection Plan benefits after the first year.  This offer cannot be combined with a warranty in which the seller has purchased the warranty on behalf of the buyer in the sales agreement.  Optional coverages are sometimes available for an additional cost. Product availability is subject to property location. Neither Weichert Financial Services, Weichert, Realtors®, nor its affiliated companies, is the provider of the Weichert Home Protection Plan. The Weichert Home Protection Plan issued by HomeSure Services, Inc. and its affiliates, and are administered by Cinch Home Services, Inc. Insurance Quote
Buyers and sellers are eligible to receive a $50 gift card from Weichert Insurance Agency, Inc. for request an insurance quote for auto or home insurance. Beginning May 1, 2022, Weichert Insurance Agency, Inc. will no longer offer a $50 gift card for insurance quote requests.  Eligible Policy Types are home (no renters unless it is an auto package), auto and dwelling. To receive the gift card, eligible participants must receive a quote along with a review of the quote with an insurance advisor. One gift card per household per year. Payment will be made in the form of an Amazon gift card. The card that may be awarded will not be transferable, redeemable for cash or exchanged for any other item of value. The value of any award may be reported for tax purposes as required by law. By submitting information for a quote, you agree to allow Weichert Insurance Agency, Inc. to use this information to obtain quotes with various insurers for comparison purposes. No purchase is required. Existing customers of Weichert Insurance Agency, Inc. are not eligible unless there is an opportunity to quote either their primary home or auto policy. The Weichert^® Performance Guarantee
Qualified borrowers of first lien purchase-money mortgages may be eligible to receive the $5,000 Weichert Performance Guarantee (the “Weichert Performance Guarantee”) from Weichert Financial Services. Specific terms and conditions apply, and not all borrowers will qualify. To determine whether you qualify for the Weichert Performance Guarantee, please contact one of our Mortgage Advisors for more information. Available at participating Weichert^® franchises. Weichert Financial Services may, at any time and without notice, change the terms or discontinue the Weichert Performance Guarantee, except for eligible purchase transactions submitted before Weichert Financial Services’ withdrawal, termination, or amendment.  Once an eligible buyer registers for the all the We Do It All, Guaranteed! Program, the seller of the property will be eligible to register for the Weichert Performance Guarantee.    The seller must be the record owner and seller of the real property described in the original purchase contract between buyer and seller.  The Seller Guarantee is available only to Sellers who are persons; selling entities, including banks, sole proprietorships, partnerships, limited liability companies, corporations are not eligible for the Seller Guarantee.  Furthermore, co-ops and properties purchased through a “short sale” are not eligible for the Seller Guarantee, and for purchases using FHA loans the seller must have owned the property for at least 180 days at the time the contract is fully executed.
The Weichert Performance Guarantee guarantees that Weichert Financial Services or any Weichert Partner will not delay the closing date agreed upon by the buyer and the seller in the original purchase agreement (“Guaranteed Closing Date”). The fully executed purchase agreement must identify a specific closing date not to occur sooner than thirty (30) calendar days after the date that Weichert Financial Services receives the fully executed first lien purchase money mortgage application*. If the Guaranteed Closing Date is delayed solely due to the non-performance of Weichert Financial Services or a Weichert Partner, you will be eligible to receive the Weichert Performance Guarantee in effect when the buyer submitted their first lien mortgage application. The Weichert Performance Guarantee may not be available in all areas. Available at participating Weichert^® franchises. For qualified borrowers participating in a relocation program managed by Weichert Workforce Mobility Inc. (“Mobility Borrowers”), all equity funds must be verified five (5) days prior to closing by Weichert Financial Services.

Buyers and sellers ARE eligible to receive the Weichert Performance Guarantee if:

1. Buyer uses Weichert, Realtors^® for the purchase of 1-to-4 family owner occupied primary residence or second/vacation home and close their real estate purchase transaction using a Weichert Partner for title settlement services (where available);
2. Buyer obtains a conventional FNMA, FHLMC, or FHA purchase-money mortgage from Weichert Financial Services for the purchase of a 1-to-4 family owner-occupied primary residence or second/vacation home in DE, MD, NJ, PA, VA, the District of Columbia or NY (excluding the counties of Bronx, Kings, New York, Queens and Richmond);
3. Buyer uses a Weichert Partner for title settlement services (where available);
4. Buyer obtains a homeowners insurance quote from Weichert Insurance Agency, Inc.;
5. The closing date set forth in the executed purchase agreement is at least 30 calendar days from the binding date of the purchase agreement;
6. Buyer submits to Weichert Financial Services a completed and signed first lien purchase-money mortgage application;
7. Buyer submits all loan documents required by the first lien purchase-money mortgage application, including all pages and addendums to the final fully executed purchase agreement specifying a closing date;
8. Buyer submits a signed interest rate lock-in agreement no later than ten (10) business days before the Guaranteed Closing Date;
9. The Intent to Proceed Disclosure must be returned to Weichert Financial Services no later than 48 hours after receipt. Failure to do so may disqualify the buyer from the program;
10. Buyer satisfies all conditions and contingencies specified in the fully executed purchase agreement required by Weichert Financial Services; and
11. As determined by Weichert Financial Services the buyer satisfied all loan conditions outlined in the Mortgage Commitment Agreement, and provided evidence of satisfactory title, an acceptable appraisal, and before Guaranteed Closing Date the buyer(s) completed the sale of their primary residence or second/vacation home (if applicable). Information provided by the buyer is subject to review and all other loan conditions must be met. Additional documentation may be required.

Buyers are NOT eligible to receive the Weichert Performance Guarantee if:

1. Buyer(s) applies for a V.A., Jumbo or specialty mortgage products and/or change the type of mortgage they originally applied for to a state government loan program;
2. Buyer's application for a first lien purchase money mortgage was submitted on or before June 21, 2021;
3. Buyer’s application for a first lien purchase money mortgage is denied for the following adverse actions: denied; withdrawn; closed for incompleteness; approved not accepted; suspended; or is delayed in final approval due to third party conditions or regulatory requirements;
4. The Guaranteed Closing Date is changed or delayed by the buyer, the seller or any other party without the consent of Weichert Financial Services and the participating Weichert Partner(s). However, if the buyer gives Weichert Financial Services AND the Weichert Partner written notice at least seven (7) business days before the closing date listed on the original purchase agreement, the buyer may extend the closing date for up to an additional seven (7) business days; or
5. The Guaranteed Closing Date is delayed due to a force majeure event, including weather or natural disaster, or as a result of unforeseen circumstances related to the COVID-19 virus, or other reasons outside of the control of Weichert Financial Services or the Weichert Partner.
6. For Mobility Borrowers only: (i) all equity funds are not verified five (5) days prior to the Guaranteed Closing Date, or (ii) the Guaranteed Closing Date is delayed by the Mobility Borrower, the seller or any other party providing services required by Weichert Financial Services or Weichert Workforce Mobility Inc., including but not limited to appraisal management companies.

If the buyer is ineligible for the Weichert Performance Guarantee, the seller is also ineligible.

We Do It All, Guaranteed! EXCLUSIONS AND LIMITATIONS
The participating Weichert companies reserve the right to discontinue, cancel or modify the We Do It All, Guaranteed! program at any time without prior notice. Employees, agents, and family members of the participating Weichert companies and their affiliated companies, including Weichert, Realtors^®, Weichert Financial Services and participating Weichert^® franchises, are not eligible to participate in the We Do It All, Guaranteed! program. Payments made under We Do It All, Guaranteed! program, including Weichert Performance Guarantee payments, may be reportable to IRS on form 1099-MISC.

GOVERNING LAW; LIMITATION OF DAMAGES AND ARBITRATION: You agree that:

1. The Weichert Performance Guarantee will be governed by the laws of the State of New Jersey, without regard to its choice of law or conflict of laws principles;
2. IN NO EVENT SHALL ANY WEICHERT PARTICIPATING COMPANY, WEICHERT PARTNER OR THEIR VENDORS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE OR CONSEQUENTIAL DAMAGES OR FOR ANY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE OR PROFITS, OR ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE SERVICES OR PRODUCTS PROVIDED HEREUNDER WHETHER DUE TO A BREACH OF CONTRACT, BREACH OF WARRANTY, THE NEGLIGENCE OF ANY WEICHERT PARTICIPATING COMPANY, WEICHERT PARTNER OR THEIR VENDORS OR OTHERWISE.
3. In any and all disputes arising out or connected in any way with the Weichert Performance Guarantee you will NOT be entitled to receive more than $5,000; and
4. Any and all disputes arising out or connected in any way with the Weichert Performance Guarantee will be resolved individually and exclusively by final and binding arbitration administered by the American Arbitration Association (AAA) conducted before a sole arbitrator and held in New Jersey. Arbitrator’s decision shall be controlled by this description of the Weichert Performance Guarantee and shall apply only to the individual initiating the dispute. Arbitrator will not have the power to award special, consequential, incidental, punitive, or other similar damages.

The Weichert Performance Guarantee Claims
All claims for payment of the Weichert Performance Guarantee must be made in writing to Weichert Financial Services within thirty (30) business days following the closing date to: Mortgage Access Corp. d/b/a Weichert Financial Services, 225 Littleton Road, Morris Plains, NJ 07950 Attn: Guarantee Claims Department, or you may email the claim to goldclaims@weichertfinancial.com. Claims submitted and postmarked after thirty (30) business days after the closing will not be honored.
